I want to ask about reserved period of payment of unemployment insurance premiums in Vietnam. In 2017, I received 2 months of unemployment insurance, then I continued to participate in unemployment insurance at my workplace. However, are the remaining months of unemployment insurance not reserved or are only counted the number of months participating in unemployment insurance at the new unit?

    • Regulations on reserved period of payment of unemployment insurance premiums in Vietnam

In Clause 4, Article 53 of the Employment Law 2013, it is stipulated:

      4. Workers who stop receiving unemployment allowance in the cases specified at Points b, c, h, l, m and n, Clause 3 of this Article may have the period of payment of unemployment insurance premiums reserved for calculating the subsequent duration of receipt of unemployment allowance when they fully satisfy the conditions specified in Article 49 of this Law.

The reserved period equals the total of the periods of payment of unemployment insurance premiums minus the period during which the worker has received unemployment allowance, with one month of receipt of unemployment allowance equivalent to 12 months of payment of unemployment insurance premiums.

Thus, if you have received 2 months of unemployment benefits, it means that the number of your unemployment insurance contributions has been deducted for 24 months. In case you previously participated in UI for more than 24 months, the number of months you have not received will be reserved. If it is only 24 months or less than 24 months, it means you have received all the time you have paid for unemployment insurance that you have paid before.

      Best Regards!
