My child is 17 years old, working for an acquaintance in a garment company and has been working for more than a year. According to Vietnamese law, how many days of annual leave and fully-paid salary does my child have?

    • Pursuant to Point b, Clause 1, Article 113 of the Labor Code 2019 stipulates annual leave as follows:

      1. Any employee who has been working for an employer for 12 months is entitled to fully-paid annual leave, which is stipulated in his/her employment contract as follows:

      a) 12 working days for employees who work in normal working conditions;

      b) 14 working days for employees that are minors, the disabled, employees who do laborious, toxic or dangerous works;

      And in Article 143 of this Code, there is a provision that minors are workers who have not reached the age of 18.

      Therefore, your 17-year-old child who is a minor in this case is entitled to 14 working days of leave in accordance with the above provisions in Vietnam.
