If employee works for 12 months for both companies, are they entitled to annual leave and fully-paid salary in Vietnam?

I have the following question: I have signed two contracts for two different companies, so far I have worked for these two companies for 12 months. So am I entitled to annual leave and fully-paid salary in Vietnam for both companies?

    • Pursuant to Clause 1, Article 113 of the Labor Code 2019 stipulates annual leave as follows:

      1. Any employee who has been working for an employer for 12 months is entitled to fully-paid annual leave, which is stipulated in his/her employment contract as follows:

      a) 12 working days for employees who work in normal working conditions;

      b) 14 working days for employees that are minors, the disabled, employees who do laborious, toxic or dangerous works;

      c) 16 working days for employees who do highly laborious, toxic or dangerous works.

      Thus, the law of Vietnam stipulates that an employee working for 12 months for an employer is entitled to annual leave and fully-paid salary under the labor contract. Therefore, you work in 2 places and meet the time as above still apply the leave regime for 2 places of work. However, in order to avoid overlapping leave, you can agree with the company on the number of days off and on which days off should be taken.
