What are regulations on workplace regarding Labor Code in 2019 of Vietnam? Is workplace a compulsory agreement in labor contracts in Vietnam? Thank you! 

    • Workplace regarding Labor Code in 2019 of Vietnam

      There are no specific regulations on workplace in Labor Code in 2019. However, we can understand that workplace is the place where employees carry out works as signed in the labor contracts.

      However, there are regulations related to workplace as follows:

      Pursuant to Article 205 of the Labor Code in 2019 stipulating notice of temporary closure the workplace in Vietnam as follows:

      At least 03 working days before the date of temporary closure of the workplace, the employer shall publicly post the decision on temporary closure of the workplace at the workplace and notify the following organizations:

      1. The representative organization of employees that organizes the strike;

      2. The People’s Committee of the province where the workplace is located.

      3. The People’s Committee of the district where the workplace is located.

      Pursuant to Article 206 of the Labor Code in 2019 stipulating temporary closure of the workplace is not prohibited as follows:

      1. 12 hours prior to the starting time of the strike as stated in the strike decision.

      2. After the strike ends.

      Is workplace a compulsory agreement in labor contracts in Vietnam?

      A labor contract shall have the following major contents:

      - The employer’s name, address; full name and position of the person who concludes the contract on the employer’s side;

      - Full name, date of birth, gender, residence, identity card number or passport number of the person who concludes the contract on the employee’s side;

      - The job and workplace;

      - Duration of the employment contract;

      - Job- or position-based salary, form of salary payment, due date for payment of salary, allowances and other additional payments;

      - Regimes for promotion and pay rise;

      - Working hours, rest periods;

      - Personal protective equipment for the employee;

      - Social insurance, health insurance and unemployment insurance;

      - Basic training and advanced training, occupational skill development.

      As regulations above, workplace is a compulsory content in labor contracts in Vietnam.
