My husband owes a large amount of money due to gambling, so he arbitrarily sold the house that we and our children were living in as my husband's private property without consulting me. May I ask if my husband broke the law in this case?
Pursuant to the provisions of Article 31 of the Law on Marriage and Family 2014, there are regulations on transactions related to the home being the sole domicile of husband and wife as follows:
The establishment, making and termination of transactions related to the home being the sole domicile of husband and wife shall be agreed by both of them. In case the home is under the separate ownership of the husband or wife, the owner has the right to establish, make and terminate transactions related to that property but shall ensure domicile for the couple.
Thus, in case the house is your husband's private property in Vietnam, your husband has the right to sell the house but must ensure accommodation for other family members. In your case, it is legal for your husband to sell the house if your husband has a guarantee of accommodation for you and your children.
