What are the penalties for a composition be translated into another language without author's permission in Vietnam?

Pursuant to Article 12 of Decree 131/2013/ND-CP as amended by Clause 2, Article 3 of Decree 28/2017/ND-CP regulating the infringement of the right to make derivative works as follows:

1. A fine of between VND 5,000,000 and 10,000,000 shall be imposed for making derivative works without permission of the copyright holders.

2. Remedial measures:

Forcibly removing copies of the work which is infringed, in electronic form, on internet and digital environment, for violations specified in Clause 1of this Article.

According to this Article, the act of translating the work into another language without the author's permission is subject to a fine of between VND 5,000,000 and VND 10,000,000 in Vietnam. It is also mandatory to remove copies of infringing works electronically, in the network and digital environment for violations.

What are the penalties for the performance of the composition on the television show in Vietnam without the author's consent sanctioned?

According to the provisions of Article 13 of Decree 131/2013/ND-CP regulating the violation of the right to perform works in public as follows:

1. A fine of between VND 5,000,000 and 10,000,000 shall be imposed for live performance of a work to the public without permission of the copyright holders in accordance with regulations.

2. A fine of between VND 10,000,000 and 15,000,000 shall be imposed for performance through audio- or video-recorded programs or whatever technical means accessible by the public without permission of the copyright holder in accordance with regulations.

3. Remedial measures:

Forcibly removing copies of phonogram, video recording, which are infringed, for violation specified in Clause 2 of this Article.

According to this Article, the performance of the work on the video program without the consent of the author is subject to a fine of between VND 10,000,000 and VND 15,000,000 in Vietnam. Compulsory removal of copies of audio and video recordings of violations.
