1. How much is fine for throwing cigarette ashes at parks in Vietnam?

Pursuant to Clause 2a, Article 25 of Decree 45/2022/ND-CP on offences against regulations on environmental protection in public areas, urban areas and residential areas; transport of raw materials, materials and goods causing environmental pollution as follows:

1. A warning shall be imposed for failure to post regulations on environmental hygiene in public areas.

2. Penalties for collecting or discharging waste in contravention of regulations on environmental protection are as follows:

a) A fine ranging from VND 100,000 to VND 150,000 shall be imposed for throwing, littering or discarding cigarette butts, leftovers and ashes at undesignated locations in apartment buildings, commercial, service or public areas;

b) A fine ranging from VND 150,000 to VND 250,000 shall be imposed for addressing personal sanitation needs (e.g. urination, defecation) at undesignated locations in apartment buildings, commercial, service or public areas;

c) A fine ranging from VND 500,000 to VND 1,000,000 shall be imposed for throwing or littering waste or pouring wastewater at undesignated locations in apartment buildings, commercial, service or public areas, except for the offence mentioned in point d of this clause;

d) A fine ranging from VND 1,000,000 to VND 2,000,000 shall be imposed for throwing or littering domestic waste on sidewalks, pavements or municipal sewerage systems or surface water drainage systems; for pouring wastewater at undesignated locations on road sidewalks or pavements; discharging domestic plastic waste into ponds, lakes, channels, rivers, streams or sea.

Therefore, for your behavior when throwing cigarette ashes on the road to the park area in Vietnam is a public place, a fine of from 100,000 VND to 150,000 VND shall be imposed.

2. How much is fine for selling tobacco products to persons 15 years old in Vietnam?

Pursuant to Point b, Clause 2, Article 26 of Decree 117/2020/ND-CP stipulating the above content as follows:

1. A fine ranging from VND 1.000.000 to VND 3.000.000 shall be imposed for failing to display the notice stating “It is illegal to sell tobacco products to anyone under the age of 18” at points of sale of a tobacco wholesale or retail dealer.

2. A fine ranging from VND 3.000.000 to VND 5.000.000 shall be imposed for commission of one of the following violations:

a) Displaying more than one pack, carton or box of a tobacco brand at a tobacco retail agent or point of sale;

b) Selling or supplying tobacco products to persons aged under 18;

c) Selling or supplying tobacco products which are not labeled or whose packages do not indicate health warning as prescribed by law. If tobacco products which are not labeled or whose packages do not indicate health warning are illegally imported, the violation shall be penalized in accordance with regulations on penalties for administrative violations against regulations on commerce, production and trade in counterfeit and prohibited goods, and protection of consumer rights.

3. Additional penalty:

Business operations involving the violation in Clause 2 of this Article shall be suspended for a fixed period of 01 – 03 months.

4. Remedial measure:

The entity committing the violation in Point c Clause 2 of this Article is compelled to recall and remove violating elements of tobacco products which are not labeled or whose packages do not indicate health warning. If violating elements cannot be removed, tobacco products shall be destroyed.

Therefore, the act of selling or supplying tobacco products to persons aged under 18 in Vietnam will be fined from VND 3,000,000 to VND 5,000,000 (for individuals) from VND 6,000,000 to 10,000,000 (for organization). In addition, suspending business activities related to violations for a period of from 01 month to 03 months for the acts specified above.
